The Valley Guards were incorporated into the 10th Virginia and His commission for Lt. Colonel was on August 1, 1861. The commission for Colonel was on May 8, 1862 after the 10th Virginia's Colonel Simeon B. Gibbons was killed at the Battle of McDowell.
 
He missed the battle of Antietam because he was doing garrison duty at Martinsburg, West Virginia after it's abandonment, His brigade was commanded by a Colonel James W. Jackson in his absence.
