One biography states that Johnston was the first person who sided with the Confederacy to serve in the U.S. Senate. Anyone who fought for or served the Confederacy was not eligible to serve until a 2/3 vote by Congress made them eligible but Johnston's name was removed from that list because he had earlier helped care for a elderly former slave.
