His battery was detached from Hampton's Legion in July of 1862 and became known as "Hart's Battery". His famous battery saw action in nearly 150 battles and skirmishes.

In1861 he was a lieutenant in Co. A of the Hampton Legion Artillery and was promoted to Captain when Stephen Dill Lee was promoted to Major. About this time the battery was supplied with 4 Blakely rifles.
