He was a Congressman and was just reelected in 1860 and did attend the first session. But having accepted a commission as Colonel in 1861 it was ruled that neither he nor his contestant were entitled to that seat in Congress. But by then (Jan.1864) Vandever was already a brigadier.

In November of 1864 he was assigned to court-martial duty an served on the court-martial case of Thomas Sweeny.
