At Ezra Church, Toulmin rose to command after the wounding of two brigade commanders and the death of the 22nd's Colonel Hart. He would take command again at Bentonville, before the final surrender at Bennett Place.

Toulmin commanded the regiment at Chickamauga after the wounding of Lt. Colonel Weedon. The regiment suffered heavily in the battle, lossing 44 killed and 161 wounded out of 371 men engaged.
