Him and Governor Brown attempted to get the Confederacy to make Phillips brigadier by sending Phillips and the 4th State Brigade to Virginia if Phillips could lead and allow the 4th to return to Georgia if defending the state became necessary.Jefferson Davis declined the "offer".The artillery portion of the Legion had already been accepted by Davis. Later a Legion comprised of 6 companies of rifles/infantry and 4 companies of cavalry was sent to Virginia with Phillips as it's commissioned Colonel The Legion joined General John B. Floyd's regiment near Sewell Mountain.
