At Shiloh, Marmaduke commanded the 3rd Confederate Regiment (Formerly the 18th Arkansas, known as Marmaduke's 18th to avoid confusion with another 18th Arkansas; it was changed when 2 Mississippi and 1 Tennessee companies were assigned to the regiment). This regiment would serve with Liddell's/Govan's Arkansas Brigade for most of the rest of the war.
 
His commission as major general came through during his confinement and he was not released until July of 1865. So even though he became a major general he never served above the rank of brigadier.
 
Private James Dunlavy, Third Iowa Cavalry, received the Congressional Medal of Honor for capturing General Marmaduke at Mine Creek after a Union cavalry charge broke the Confederate line:

“I saw some rebels, dressed in the Federal uniform, and mistaking them for Union soldiers, started toward them. When I got within a short distance, General Marmaduke saw me shooting at the ‘Butternuts,’ and mistook me and started towards me. I had the advantage of him, so I let him come up. I leveled my carbine upon his breast and ordered him to surrender.”
 
I'm a little curious about that picture of Marmaduke. Isn't that the uniform of a major general in that photo?If he was being held captive at Fort Warren on the date of his promotion (March 18, 1865) how was a photograph of him taken?
 
One source states he was promoted to major general on March 8, 1865, two others state it was March 18, 1865. Either way it was in March of 1865 and he was the last Confederate brigadier to be appointed major general.

A brigadier's picture taken in a major general's uniform is puzzling but so are the 2 pictures of Marmaduke. The first one with the long greasy hair has been around and all are familiar with it. But the gentleman on the cover of Jerry Ponder's book appears to be of a different gentleman, a little older, a little heavier, with a smaller nose?
