He was nearly captured at Gettysburg in an embarrassing incident:
 
Colonel Doles took over command of the brigade in D.H.Hills Division when General Ripley was wounded at Antietam. This left Major Smith in command of the 4th Georgia until he was killed and a Captain Wills took over command for the remainder of the battle.This is the same brigade he led as brigadier general at Fredricksburg and Chancellorsville. The brigade had been changed up up a little by Chancellorsville though and consisted of all Georgia Troops.It was made up of the 4th, 12th, 21st, and the 44th Georgia Infantry Regiments. And it was now in Rodes Division.

A large number of Doles' men and a battery were captured on May 10, 1864 when Emory Upton's brigade made a sudden assault on the Confederate lines.
