It hasn't been explained as to just why he declined a commission as Brigadier general in the Confederste Army and served out the war in the ordnance department as a It. Col.

When he defended Rich Mountain with those 4 companies he also had 1 gun. It was against a column under William S. Rosecrans.

So he was never really a brigadier general, or was he one for 3 months.

I'm guessing he never was. The way his biographys are worded he never resigned he declined.

His capture by the Union Army near Laurell Hill was near a Mountain cabin were he had just recovered from his wounding at Rich Mountain. He had been "in secret" there while recovering and while he was the Union Army moved between him and the Confederate army.
