I'd say that's probably Gilbert Ely of the 1st Kentucky Infantry. His full CSR is on Fold3, and it's a hot mess, with a promotion to Lt., a resignation of his commission, a court martial, another promotion to Lt., and all sorts of other goodies in there. In service 1861-64, and he seems to have seen a lot of combat, some of it possibly with Confederates. Never a dull moment.

Thanks for the comments on this. I have that photograph and had put it far back in my mind. I started looking at it again today and found this thread on a Google search. His file is a hot mess, but might make for an interesting story, if I can read enough of the writing on the documents and maybe dig into his gnealogy a bit. For snyone interested, he is buried in Dayton, Ohio, so my guess is he was in the Soldier's Home there, though I will look into that. His headstone is on find-a-grave
