Help Identify this (I think he's a) General

Is the man seated a general? Hard to tell if there's a star. He's not Banks.

Hmm..looking through other pictures I think it is General Erastus Tyler and his staff. It could be when he was shortly put in command of VIII Corps. http://en.wikipedia.org/wiki/Erastus_B._Tyler
He was in command of the VIII Corps from September 28, 1863 – October 10, 1863, succeeding Robert C. Schenck.

It also could be when he put on B.General in May 1862. Shortly before getting arse whipped by Jackson. So ya, Erastus Tyler is his nameO. Glad could help ya, fun figuring stuff out.

After seeing how they seemed to use some pine trees as shade, and quite a few of them squinting in the sunlight, I would assume this picture wasn't in sept-oct timeframe but maybe it was in may or june 1862 shortly after pinning on his rank. I don't see high level generals near him so maybe it wasn't when he was temporarily in charge of VIII corps. WHat ya think?

Winner, winner, chicken dinner!! Yes, it is Erastus Tyler. I searched all the photos in my computer and couldn't find him. Now when I look under 'Generals T' he is right there looking back at me. Thank you so much!

The National Archives has Gen. Robert O. Tyler named as Gen. Erastus B. Tyler. And Gen. Erastus B. Tyler named as Gen. Robert O. Tyler. No surprise.

what is funny is i just went through pictures of generals online that I thought looked like this guy you had in this post, his ear was something I concentrated on, can't miss that thing. LOL

Mike, just look at his buttons! That's the usual spacing for brigadier generals, 2 rows of 8 placed in pairs. Major generals' buttons were 2 rows of 9 placed in three sets of 3 buttons each. When Grant became a full general after the war he briefly wore 2 rows of 8 but placed in 2 groups of 4 buttons each.

What's wrong with this picture? ( This is from my collection and I've posted it before. ) This cabinet card reproduces a CDV photo of then-Maj. Gen. John Newton wearing his 2-star straps tacked onto his brigadier's coat ( note button spacing ), indicating it was likely taken very soon after his promotion and before he ordered or received a "proper" major general's frock.
