Somewhere on Henry Hudson's river.
I found this photo a few days ago. I think it's of a soldier of the early war Confederate militia. He wears the M1858 Hardee hat, with the old 1833 infantry bugle insignia.

Could go either way as has been said milita on both sides early in the war were uniformed in variety of uniforms and a variety of colors, there was a unit from Iowa called the Iowa Grays for instance due their uniforms being.....well gray.State militias did though often have state specific belt plates as has been said, so that would probably be your best bet.
 
That wouldn't have worked, because I didn't go onto the website, I just looked at the picture
