Liability Issues for small unit.

Who should sign liability waivers?
  • Members of course
  • What about family/friends camping with member or otherwise camping with unit?
  • People that 'fall in' with the unit for drill?
  • Others?
Does a unit with minimum assets need liability insurance?
 
At most reenactment events these days ALL participants are generally required to sign a waiver.. regardless of their portrayal or impression... armed and handling weapons or not... Its typically a routine disclaimer to protect property owners, sponsors, and hosts from being sued if someone does something stupid or has an accidental injury.

Most units that are affiliated with a larger umbrella organization obtain liability insurance through the umbrella group. It generally doesn't matter what assets or size a unit may have or doesn't have... the group and/or the individual in question can still be sued just as well if they do something goofy that causes a problem or injury to another....
 
I have never signed a waiver for a drill, that said it was with unit regulars who knew what they were doing and would accept responsibility should something have occurred. Sadly, in today's world it is best to err on the side of caution and have all members sign waivers when "enlisting" and any other participants as they are involved.
Umbrella organizations are a great way to cover yourself. At the risk of promoting one over another I will say that Cleburne's Division has been most satisfactory with their unit and event insurance. Their policy even allows for coverage of parades and the like.

Thanks. OTOH if a group has assets less in value than a court cost, then litigation is just a theory.
 
As far as I am aware, our Company has insurance independent of a larger umbrella group we (in a general sense) belong to, which is much more extensive. Members, civilian, military both have to sign waivers and liability papers at the same time dues is submitted for membership for the next year. Juveniles are the responsibility and liability of the parents. My Federal group is a "U.S. Regular Infantry" group to which, have acted most responsible at all times and treat all with respect. Yes, kidding and teasing happens but, when weapons are involved they are dedicated to safety.

Registering for events, e.g. Battle of New Market Heights/Campaign Before Richmond; Cedar Creek--there are waivers to be signed before proceeding further. Some get their camp ship shape and then go to registration and sign the waiver.

The Unit gets some insurance courtesy of the NRA, not sure about the rest, will ask at the X-Mas meeting in December, providing I remember.

The event I run/ran got insurance from the state as it is a State historical site.
