My first thought was the first photo was an earlier uniform from Mexican War period or even earlier. However those cuffs on his sleeve does not seem correct for any military uniform. Also — is that a photo or a photo of a painting?
Was he old enough to have served in the Mexican War?

No he was born in 1833

Here's some more info about his death
Captain Kinard enlisted as First Lieutenant of Company F, and became Captain on the resignation of his uncle, John P. Kinard. The regiment was encamped around Charleston in 1862-3. They defended Morris Island during the bombardment. The regiment was ordered to Virginia in 1864. During a fight in the Shenandoah Valley, near Strasburg, and not far from Winchester, Va., Captain Kinard, while acting Lieutenant-Colonel, was shot through the heart, October 13, 1864. After the fight his faithful servant, Ham, secured the body and brought it home.

The cuffs are most likely from the shirt and not the coatee. He also appears to be wearing doeskin breeches, which were quite popular with militia officers of the antebellum period.

I almost did a spit take when I saw the first image. I thought he forgot his pants! I´m so glad you mentioned doeskin trousers.
