Belt plate tell what state he came from?


What type of sword does he have? Is it a presentation sword?

What type of sword does he have? Is it a presentation sword?
Looks like he's wearing a wheeler cap. Those hats are about 1840 and up until the next regulation change in headgear about 1851. The buckle looks to be a two piece interlocking buckle also from the 1830's and 1840's to go with his hat style. Though interlocking buckles went throughout the civil war as well. His rank is captain. His sword can't be identified as a presentation because we can't see if it's inscribed
 
It is just a foot officer's sword apparently.

Here's a comparison of an 1850 regulation style foot officers' sword with its customary brass mounted leather scabbard at top, and an American sword of similar type, copied from a French foot officer's sword of 1821, with iron scabbard somewhat like the captain in the photograph.
