By the start of the Civil War some of the Northern state were starting to allow blacks to serve in the militia. In 1857 both New Hampshire and Vermont repealed their laws against black enlistments in the state militia.
I know that the US Army did not accept militia units with black members, but under what law or regulation? The President asks the states for troops and the states send militia units or raises new units. Could the President simply say they would not accept black militia companies? I do wonder what would have happened if a governor included a black company in a militia regiment sent to the Federal government.
