A wounded Zouave in a deserted camp near Falmouth, Va. He is thought to be a member of the 62nd New York Infantry (Anderson Zouaves). The badge he is wearing may be a relic of the Crimean War as one company was composed of French Army veterans who had served in the Crimea. (National Archives)

I would say so too. 7th Corps. The 7th Corps was disbanded in August 1, 1863. The 62nd first served in Couch's 4th Corps until October 1862 Then the 62nd New York was a 6th Corps unit from that time on, both in the 2nd and 3rd Brigades of the 3rd Division, 6th Corps. If the unit is the 62nd, then they were never in the 7th Corps. It think it is a Masonic Badge, as a chained watch fob, just my opinion. There are colorized versions of this image. it is still a neat image.

Or the regiment could be misidentified.

I see that the 164th New York was part of the 7th Corps, Department of Virginia, by late 1862 through 1863: http://civilwarintheeast.com/us-regiments-batteries/new-york-infantry/164th-new-york/

It was a Zouave regiment, though not sure if this soldier's uniform matches theirs. According to here the 164th received their Zouave uniforms in February 1863.
 
I wondered if the unit is misidentified. What you are saying does makes sense. I wondered the same thing when I was looking at the uniform pictures. It could have been misidentified a long time ago. I know Zouave uniforms sometimes changed also.
