General George Pickett

Edit - Upon further review, it appears there was more than one soldier to hold commissions in both armies simultaneously.

I found a source that says Pickett had been given a commission as a major in the CSA artillery on March 16, 1861, but did not resign his commission in the US Army until June 25. So I will give credit for this answer.

Frank Armstrong?

Edit - OK, I found a source indicating that this answer, also, is technically correct.

Armstrong was a commissioned officer in the US Army at the beginning of the war. He submitted his resignation and joined the CSA on Aug. 10, 1861 as a staff officer. However, his resignation from the US Army didn't become effective until Aug. 13, so for three days he was a commissioned officer on both sides.

Alfred Thomas Archmedes Torbert held commissions in both USA and CSA armies simultaneously.
