with a bunch of colonels to follow that make it a done deal for me. i don't think there was some other major general present who kinda go shot accidentally while being on vacation in atlanta

Edit - Polk was the highest ranking Confederate killed during the Atlanta Campaign, but he was killed before the Battle of Atlanta took place.

He did resign from the U. S. Army in 1827, but did so in order to enter seminary, rather than to join the Confederate Army that didn't exist at the time.

My guess is that is Major General William Henry Talbot Walker, although I have not found anything indicating that he was the first officer to resign from the US Army to join the Confederate Army.

William Henry Talbot Walker should be our guy. Killed in Atlanta. One source said he resigned from the US Army on the day South Carolina succeeded. That is a pretty early resignation.

I'll say Major General William Henry Thomas Walker - resigned his commission in December, 1860 died in Atlanta - July 22, 1864 - ironically the same day General James B. McPherson died.
