The Richmond authorities appointed him Brigadier on April 17, 1862. This was done during his "recovery". He had been wounded on the March 7th and was moved so he wouldn't be captured and died on the 21st of March. Richmond possibly did not know of his passing.
 
Slack was given command of the 2nd Brigade,Confederate Volunteers in Price's Division. This brigade was made up of members of the Missouri State Guard who decided to enlist in the Confederate service instead of remaining in the State Guard.
