He took the job as Captain of Co. H of the 9th North Carolina Cavalry after declining the rank of colonel of infantry. The 9th was also known as the 1st.North Carolina Cavalry. The Colonel of this unit at the time was a (later General) Col.Robert Ransom.
 
His mortal wounding was during a Cavalry charge at Auburn's Mill,near Fairfax Court House. He fell from his horse and was captured with a minie ball in his forehead.Biographys differ on his wounding and death. One has him being shot on the 14th of October and dying on the 17th. Still another has his wounding on the 15th of October and dying on the 18th.And still another lists the 13th as the fatal wounding and him lingering for 3 days.
