His first promotion as brigadier expired on March 4,1863. He was reappointed on March 13th.Then resigned on May 9, 1863.He did however lead a militia unit a colonel of the 39th Pennsylvannia when Lee entered Pennsylvania.He also led a 100 day unit (194th Pennsylvannia) when Early threatened part of Maryland.
