His resignation was due to him feeling "passed over"in command by his superiors. He resented the appointment of fellow Colonel Samuel P. Spear to John Dix's Cavalry division.

His resignation from the army was on June12, 1863 but he offered his services a month later for the New York City Draft Riots. His volunteering was accepted.
