Judge Anthony Napolitano on Lincoln

I was doing a bit of research re: the Healthcare bill, and came across this interview with Judge Anthony Napolitano. For background, the man was the youngest Supreme Court Justice to attain lifetime tenure in New Jersey. He's a conservative, smart guy who doesn't toe either party's line.

Anyway, he wandered a bit off health care and said the following:

"I believe we have a one party system in this country, called the big government party. There is a Republican branch that likes war and deficits and assaulting civil liberties. There is a Democratic branch that likes welfare and taxes and assaulting commercial liberties. President Obama obviously is squarely within the Democratic branch. The president who had the least fidelity to the Constitution was Abraham Lincoln, who waged war on half a country, even though there was obviously no authority for that, a war that killed nearly 700,000 people."

O.K. folks, we seem to have a number of would be Constitutional scholars out there. The Judge is no dummy, he's obviously not a Southern apologist, and he's from New Jersey for Pete's sake. So, is he right or wrong?
