Sticky question. If the popular referendum had failed to approve secession, Lee's commission would have predated secession. Does a retroactive clause excuse the act? Or does it make the commission legitimate?

In my opinion. neither. But I brought this up because I wondered how it could be that Lee 'followed' Virginia during late April/early May 1861 when the people of Virginia had yet to vote.

IMHO.
Lee follows Virginia.
1. Virginia neutral, Lee commands Virginia defense forces.
2. Virginia Unionist, Lee goes back to US military.

3. In the real time line, Lee commands Virginia CSA forces operating mostly within Virginia.
