Just as information for those who are wondering who Brian McCanliss is, the Lew Rockwell site gives this: "Brian McCandliss is a business and economics graduate of Liberty University in Lynchburg, VA, a law student, and a businessman in Detroit, Michigan." as of 2004.
He is entitled to his opinion, but those aren't exactly impressive credentials for contradicting a US Supreme Court decision.

You are wrong on this, Hanny.
cw1865 pointed you to the 1819 McCulloch v. Maryland decision of the US Supreme Court. This established the principle that the Congress does have the ability to pass laws to implement the express powers of the Constitution, and that the states cannot interfere with the exercise of that Federal power.
If that is the question, the Supreme Court has answered it. They are empowered by the Constitution to decide the matter. Your source, Mr. McCandliss, has every right to have an opinion -- but he has no ability to decide the matter.
That is the way it works in the US. If you think something different applies, you are incorrect.

The Constitutional right of free speech only protects speech against government interference, and even in that case it does not protect falsehood, slander or libel.
