That's incredible, that someone who drives off the road and hits a tree would sue the state because the tree was there. I wonder if Indiana is doing the same thing, and how many other states are doing it.
Maybe the states should put up those diagonal caution signs that would read: "Please keep car on the road", or "Please do not drive into the woods". or "Conserve fuel, your car gets better mileage when it's on the pavement."
I think I remember hearing that Alabama juries are particularly notorious for showing sympathy to plaintiffs and manifesting that sympathy in the form of humongous monetary judgments.
If that's correct, I suppose the Alabama DOT has little choice but to be running scared at the prospect of being sued by anybody fool enough to run off the road and into a tree.
